The new approach in Colombia for the prevention and attention of the adolescents in conflict with law

Abstract

The serious social situation of the country, the inadequacy of the law for the boy-ace to the international treaties, the reformations given to world level and Latin American that the recognition of the girls and the children impel like subject of rights whose guarantee in turn influences in a decisive way in the integral development of the regions, is proclaimed the Code of the Childhood and Adolescence in Colombia under the parameters of the Philosophy of the Integral Protection and with the apparent necessity of repressing the juvenile delinquency that hits to the different population groups. Through the Code the principles of decentralization, civic participation and corresponsability of different entities, authorities and companies of the national, departmental, municipal and local levels are emphasized, including the boy-ace to make reality the public politicians that guarantee the rights of the children, the girls and support to the family in the execution of those rights, emphasizing actions for the first childhood. Articulating these components, not alone the juvenile delinquency is prevented but rather one responds to necessities and the children’s expectations and the girls and of the population in general. As for children and girls that infringe the penal law a special procedure he/she settles down for the Adolescents (people between 14 and 18 years) the one that entities and specialized authorities and experts execute in penal right, family, and childhood and relative internal and international norms to human rights. The process should guarantee the restorative justice, the truth and the repair of the damage, for the norms of the accusatory Penal System in what is not contrary to the new Code. It is for it turns, once implemented, if he/she gives answer to the population’s necessities and it is really articulated with the politicians of prevention.
